E-commerce Contract
The purchase of any product in the URBANCHICBEAUTYSHOP.COM online store implies agreement by the consumer with all the terms and conditions of this Product Sales Agreement.
Whereas:
I - URBANCHICBEAUTYSHOP.COM is a company whose main activities consist in the intermediation of products via internet;
II - The user is an individual or legal entity, regularly registered with the CPF / MF or CNPJ / MF, with correctly completed registration, whose information has been validated by URBANCHICBEAUTYSHOP.COM ;
III - The user declares to be acting in good faith and in the enjoyment of his civil capacity to enter into this Agreement, stating that he has understood, read and agrees with all the terms and conditions provided herein.
PROCEDURES OF THE PURCHASE AND SALE
Clause One: After making a request to purchase products in the online store, the user must wait for the receipt of notification via e-mail in which he will be informed about the confirmation of the requested commercial transaction.
First paragraph: URBANCHICBEAUTYSHOP.COM reserves the right not to confirm the purchase and sale in cases of:
I - User with incorrect or invalid registration information;
II - Deliveries to be made outside the delivery areas made available by URBANCHICBEAUTYSHOP.COM at the time of purchase and sale;
III - Fraud and bad faith, non-compliance with any of the conditions and policies of the site, abuse of rights, and/or other situations that imply a violation of legal provisions or illicit enrichment by the user and in the other cases provided for in accordance with applicable law.
Clause Two: The value of the purchase and sale will be present in the confirmation e-mail, and the user will be provided with the payment methods provided for on the URBANCHICBEAUTYSHOP.COM website at the time of purchase and sale.
Paragraph One: Payment by credit card may not be approved if there is inconsistency of data of the holder. The bank slip generated for payment will be valid for 03 (three) business days, being automatically canceled, if the payment is not made, after the expiration of said period.
RIGHTS AND OBLIGATIONS
Return by Repentance
Clause Three: The return of products by repentance may be made up to 7 (seven) calendar days, counted AFTER RECEIPT OF THE PRODUCTS.
Paragraph One: To exercise regret, the user must contact URBANCHICBEAUTYSHOP.COM , by e-mail at URBANCHICBEAUTYSHOP@GMAIL.COM.
Paragraph Two: The user after sending the e-mail of repentance must wait for the contact of our team, which will inform the necessary procedures for replacement of the item or return of the amounts paid.
Paragraph Three: The return provided for in this clause will only be approved by URBANCHICBEAUTYSHOP.COM after verification:
I - The effective return of the product to the supplier's distribution center;
II - Confirmation by URBANCHICBEAUTYSHOP.COM that the product has been returned unused, in its original packaging, accompanied by labels, manuals and accessories;
III - The approval of the exchange or return by the quality control of URBANCHICBEAUTYSHOP.COM , after analysis will be carried out within 10 working days;
Paragraph Four: If the user exercises regret in disagreement with this clause or contract and / or if any divergence or violation of the returned product is identified, the return will not be accepted and we will return the product to the user without prior communication.
EXCHANGE FOR PRODUCT DEFECT OR FAILURE
Clause Four: The exchange of products that have a manufacturing flaw or defect may be carried out provided that the request is made within the legal warranty period of contact after receipt of the products, under the terms of article 26 of the Consumer Protection Code.
Paragraph One: To exercise the exchange the user must contact URBANCHICBEAUTYSHOP.COM by the service e-mail URBANCHICBEAUTYSHOP@GMAIL.COM.
Paragraph Two: The exchange provided for in this clause will only be approved by URBANCHICBEAUTYSHOP.COM after verification:
I - The effective return of the product to the supplier's distribution center;
II - The confirmation by URBANCHICBEAUTYSHOP.COM that the product has been returned together with manuals and accessories;
III - The approval of the exchange or return by the quality control of URBANCHICBEAUTYSHOP.COM , will be carried out after analysis within 10 working days;
Paragraph Three: If the user exchanges the product in disagreement with this clause and / or if any divergence or violation of the product is identified, the return will not be accepted and we will return the product to the user without prior communication.
PAYMENT REFUND PERIOD
Clause Five: In the event that the payment has been made by credit card, the refund will be made on the credit card itself, and will be viewed by the user within 2 (two) invoices after the refund is completed, and may vary according to the expiration date of the card. Payment of products made by bank slip, the user will be refunded in his own account with the financial intermediary.
DELIVERY PERIOD AND CONDITIONS
Clause Six: The products are delivered from Monday to Friday, from 8 a.m. to 9 p.m. and the expected delivery time will start only after payment confirmation and logistical processing.
Paragraph One: The product delivery service is carried out solely and exclusively by the Post Office, which is also responsible for meeting the deadlines and delivery stages to the user.
Paragraph Two: Delivery may be made directly to third parties, such as porters or relatives.
Paragraph Three: Delivery may not be made within the stipulated period due to:
I - The absence of the user at the indicated address;
II - Incorrect registration data;
III - Refusal of the product by the user or third party;
IV - The change of address of the user;
V - The occurrence of any force majeure event, such as floods, natural disasters, major accidents or other occasions that prevent delivery;
VI - Strike or stoppage of activities of the Post Office;
VII - Significant increase in demand from the Post Office;
VII - Due to festive seasons, such as Christmas and New Year.
Paragraph Four: The deadline for delivery of the products is 15 to 45 working days after the posting of the same, according to the rules of the Post Office. The deadline may extend to up to 90 working days for the reasons expressed in Paragraph Three of this clause.
Clause Seven: This contract aims to ensure easy customer service, under the terms of item IV of article 4 of Decree No. 7,962/13.
Eighth Clause: URBANCHICBEAUTYSHOP.COM reserves the right to cancel the commercial transaction in the event that any situation is identified that characterizes fraud, bad faith, non-compliance with any of the conditions and policies of the site, abuse of rights, and / or other situations that imply a violation of legal provisions or illicit enrichment.
Clause Ninth: The relationship between URBANCHICBEAUTYSHOP.COM and the user is governed exclusively by the conditions set out in this agreement.
FORUM
Clause Ten: The forum for settling any matter relating to this contract shall be that of the consumer's domicile.
